Update 4:10 p.m. March 5, 2024: Fort Collins Police Officer Ryan Fandre was legally justified in using force when he shot a man holding a woman and two children at gunpoint on Feb. 7, according to an opinion letter published by the Eighth Judicial District Attorney’s Office on Tuesday.
Colten Sirio was holding a woman at gunpoint as she was pushing a stroller with two young children inside when he was contacted by Fandre, according to the decision letter.
He ignored police commands to drop his gun and used the woman as a shield to hide from police, the decision letter states.
Fandre shot Sirio once in the upper arm and chest, and he was treated and released from the hospital.
Original story: A 31-year-old man shot by Fort Collins police Wednesday was charged with kidnapping and menacing in connection with the incident, according to the Larimer County Sheriff’s Office.
Colten Sirio was allegedly armed with a handgun and “behaving in a threatening manner” toward a woman pushing two small children in a stroller near Springfield Drive and Southridge Drive when police responded to the scene at around 1:20 p.m.
Police later determined Sirio knew the woman and children.
Officers recognized Sirio from an incident on Monday, and he was wanted on suspicion of theft, criminal mischief, domestic violence and a weapons charge in that case, according to the sheriff’s office.
Sirio did not follow officer commands and walked away with the victims, according to the sheriff’s office, after which a Fort Collins police officer shot him.
The woman, children and officers were not injured.
Sirio was given first aid at the scene and taken to a local hospital for further treatment.
He was released from the hospital Friday and booked into the Larimer County Jail on the outstanding warrant as well as three counts of first-degree kidnapping, three counts of second-degree kidnapping, three counts of menacing and possession of a weapon by a previous offender.
