Suspect arrested in fatal road rage shooting at Edgewater Tesla charging station

A 39-year-old Denver man was arrested Tuesday in connection with a fatal road rage shooting at a Tesla supercharger station outside Edgewater Public Market in May.

Jeremy Smith was arrested by Edgewater police on suspicion of second-degree murder and manslaughter in the May 3 death of 33-year-old Adam Fresquez.

According to a news release from the Edgewater Police Department, Fresquez and Smith arrived at the charging station at Edgewater Public Market, 5505 W. 20th Ave., within seconds of each other at approximately 9:39 a.m.

Investigators determined that Fresquez and Smith, both driving Teslas, were involved in a road rage incident that culminated in Fresquez being maced and shot twice in the back. He was taken to a hospital and later died of his injuries, according to previous reporting.

Video evidence showed that after Fresquez and Smith arrived at the charging station, Fresquez walked toward Smith’s Tesla. Less than a minute later, Fresquez is seen stumbling, according to police. Smith then pulled out of the parking space and drove east.

Smith called 911 minutes later and reported he had maced and shot someone who had “pulled a gun” on him, according to the news release.

Investigators determined both Smith and Fresquez were armed and that Fresquez had a gun inside his clothes near his groin, according to police.

Final forensic test results came back in the case on Dec. 6, according to the news release.

In a statement, Edgewater Police Chief Eric Sonstegard said the department’s priority from the beginning of the case was to present a thorough and complete investigation.

“I recognize the tremendous toll that long wait has taken on Adam’s family,” he said. “I am thankful to District Attorney (Alexis) King and her staff for their tremendous teamwork throughout this investigation and that they will be moving forward with a criminal prosecution.”

Fresquez’s family held protests outside of the Jefferson County District Attorney’s Office over the summer demanding justice in the case, and community organizers called for an external investigation into the police department’s handling of the case.

Fresquez was a husband and the father to two young children, and family members previously said the drawn-out investigation hindered their grief.

Smith is set to appear in court on Wednesday.
